The High Court in Kampala Thursday threw out a confession statement that had heavily implicated one of the suspects in the ongoing Kampala twin bombing trial.
The same court presided over by Justice Alphonse Owiny-Dollo, threw out detective Moses Kato attached to CIID, Kibuli who had come to testify and tender in the same confession statement.
In his mini ruling, the judge held that the confession statement obtained from Muhammed Ali Muhammed after the twin bombings by detective Kato, was irregularly obtained.
The judge added the process flouted the prisons rules. However, Justice Owiny-Dollo said he would give his reasons in a detailed judgment later.
"I have considered the entire evidence and the law, unlike in the first trial within a trial, I find that this confession statement is inadmissible as the process of obtaining the same flouted the laws," he said, adding: "I will give my detailed reasons in the main judgment."
Detective Kato had told court of how the suspect (Muhammed) hid the bomb explosives in his house in Kenya that were later transported to Kampala and detonated on July 11, 2010.
The twin explosions killed at least 76 people who were watching a world cup final match at Kyaddondo Rugby Club and Ethiopian Village Restaurant in Kabalagala.
Despite detective Kato alleging that the suspect had admitted taking part in the bombings, the suspect earlier this week, made a U-turn and told court of how he was tortured by security operatives including squeezing his genitals to make him confess and also implicate other suspects that had been arrested.
Prior to the judge's mini ruling on Thursday, a host of defense lawyers led by Caleb Alaka had argued that Kato did not go with a court order to Luzira before he accessed the suspect as the prison rules demand. Read more
